Terms of Service

1. Introduction

Welcome to Near Space ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our website, mobile applications, and services (collectively, the "Platform").

By accessing or using Near Space, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Platform.

2. Description of Service

Near Space is a peer-to-peer marketplace that connects individuals and businesses who have storage space ("Hosts") with those who need storage ("Renters"). We provide a platform for listing, discovering, and booking storage spaces, but we do not own, control, or manage any of the listed spaces.

3. User Accounts

3.1 Account Registration

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

4. Hosts

4.1 Listing Requirements

Hosts must ensure that:

  • They have the legal right to list and rent out the space
  • Listing descriptions and photos are accurate and not misleading
  • The space complies with all applicable laws and regulations
  • The space is safe and suitable for storage purposes

4.2 Host Responsibilities

Hosts are responsible for:

  • Maintaining the space in good condition
  • Providing access as agreed upon in the booking
  • Responding to Renter inquiries in a timely manner
  • Complying with all applicable tax obligations

5. Renters

5.1 Renter Requirements

Renters must ensure that:

  • Items stored are legal and not prohibited
  • They treat the space with care and respect
  • They do not exceed the agreed-upon storage capacity
  • They vacate the space by the end of the rental period

5.2 Prohibited Items

The following items may not be stored:

  • Illegal substances or contraband
  • Hazardous materials or explosives
  • Perishable goods
  • Living creatures
  • Stolen property
  • Weapons or ammunition

6. Bookings and Payments

6.1 Booking Process

When you book a space, you enter into a rental agreement with the Host. Near Space facilitates this agreement but is not a party to it.

6.2 Payments

All payments are processed securely through our payment processor (Stripe). Hosts receive payment after the Renter's check-in, minus any applicable service fees.

6.3 Cancellation Policy

Cancellation terms are set by each Host and displayed on the listing. Please review the cancellation policy before booking.

7. Service Fees

Near Space charges service fees to facilitate bookings. The current service fees are:

  • Renter Service Fee: 5% of booking subtotal
  • Host Service Fee: 3% of booking subtotal

8. Liability and Insurance

8.1 Limitation of Liability

Near Space is not liable for any loss, damage, or theft of items stored in Host spaces. Renters are encouraged to maintain their own insurance coverage.

8.2 Host Protection

Hosts may be eligible for our Host Protection program, which provides coverage for certain damages. See our Host Protection Policy for details.

9. Intellectual Property

The Platform and its original content, features, and functionality are owned by Near Space and are protected by copyright, trademark, and other intellectual property laws.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy. Please review it to understand our data practices.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration.

12. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
